У мужа рабочая виза, у меня H-4. Ему сейчас одобрили i-140.
Будем вместе подаваться на I-485. В браке менее 2 лет, меня по обстоятельствам не было в стране с мужем 6 месяцев. Подскажите - будет ли это являться проблемой для меня при получении грин кард? Или можно как-то подстраховаться
A 2-year green card is also called “Conditional Permanent Residence.” There are two types of applicants that receive a 2-year green card:
If you’re applying for a marriage-based green card and you’ve been married for less than 2 years, you’ll only be eligible for a 2-year green card. This is because USCIS wants to make sure that you have a real (bona fide) marriage.
If you’re applying for an investment-based (entrepreneur) green card, and you’re already living inside the United States, you’re stuck with a 2-year green card. If you were to apply for the same visa while living outside the US, you would be eligible for a 10-year green card.
(1) The term “alien spouse” means an alien who obtains the status of an alien lawfully admitted for permanent residence (whether on a conditional basis or otherwise)-
(A) as an immediate relative (described in section 201(b)) as the spouse of a citizen of the United States,
(B) under section 214(d) as the fiancee or fiancé of a citizen of the United States, or (C) under section 203(a)(2) as the spouse of an alien lawfully admitted for permanent residence, by virtue of a marriage which was entered into less than 24 months before the date the alien obtains such status by virtue of such marriage, but does not include such an alien who only obtains such status as a result of section 203(d).
