Pro immigracionnuiu reformu poka voobsce ne bylo razgovora chto ona protivorechit konstitucii - eto ne reforma zdravoohranenia, ona ne zatragivaet prava grajdan. Eto reforma zdravoohranenia vstupaet s nimi v protivorechie.

Верховный Суд не только и не столько принимает решение – противоречит закон Конституции или нет. Верховный Суд толкует Конституционные права. В данном случае Суд твердо указывает а) что делать и б) принимает решение – делайте так и не как иначе. Вот то, как вы хотели сделать, Конституции противоречит, это незаконно. Но мы, Суд, решили назвать это налогом, а не штрафом. Штрафовать не можете, а налоги устанавливать можете. Тогда все нормально.
Никто и предположить не мог, что один (!!!) человек, Судья Робертс так истолкует Конституцию и фактически отдаст право решать судьбу Реформы избирателям. Не поддержи Робертс Реформу на выборах у нас не было бы выбора – будет Реформа или нет. Ее не было бы по факту.
После решения Суда, сами американские избиратели принимали решение – мне нравится Реформа, я не хочу чтобы ее отменили, поэтому я не хочу чтобы Президентом стал Митт Ромни. Или – мне не нравится Реформа, я хочу чтобы ее отменили, поэтому я голосую против Обамы. Американский народ свой выбор сделал.
Иммиграционная реформа может напрямую затрагивать права американских граждан. Например – воссоединяться с родственниками.

The Comprehensive Immigration Reform Press Conference has been cancelled by the Gang of 8 in light of the Boston bombing incident.
A group of Senators has delayed a high-profile announcement of a sweeping immigration reform proposal set for Tuesday because of the bombings at the Boston Marathon.
The eight-member group was scheduled to appear at an 11 a.m. news conference at the Dirksen Senate Building, joined by immigration advocates and other stakeholders, to lay out the details of the legislation that would represent the most ambitious overhaul of the U.S. immigration system in three decades.
“All eight senators believed the focus should be on victims, not other issues,” a Senate aide said late Monday. The group still intends to file the bill on Tuesday but will hold the news conference on another day.
Sen. Charles E. Schumer (D-N.Y.), a member of the group, said in a message on his Twitter account: “Thoughts & prayers are with everyone in Boston.”
The Senate Judiciary Committee has scheduled two hearings on the bill for Friday and Monday.

Senate Gang of Eight reveals details of immigration reform plan - The Hill

It would raise the cap on H-1B visas for highly-skilled workers from 65,000 to 110,000 and allow for it to rise as high as 180,000. The cap would be adjusted on the basis of a new formula, the High Skilled Jobs Demand Index, based on how many petitions are filed for the visas and the unemployment rate in the management, professional and related occupations category of Bureau of Labor Statistics data.
The compromise would create a new W-visa program for low-skilled workers. Wages for these workers would be the same as those paid to other workers employed or the prevailing wage level for the occupation in the geographical area, depending on which is higher.
W-visas would be strictly capped for the first four years after the enactment of the law, limited to 20,000 in the first year, 35,000 in the second year, 55,000 in the third year and 75,000 in the fourth year. After the fourth year, the cap would be calculated according to a statistical formula based on the rate of change of new job openings, the number of unemployed U.S. workers and other factors.
In other compromises, the bill would reduce the categories of family members eligible for green cards, eliminating siblings of United States citizens and limiting sons and daughters of citizens to those under 31 years of age. It would eliminate a lottery that has distributed 55,000 visas each year. Those visas would be used to reduce backlogs of applicants elsewhere in the system. Republicans have sought to limit what they call family chain migration and to accomplish changes without increasing the overall number of visas.

Это получается, что сенаторы хотят, чтобы планка виз оставалась такой как и прежде, просто изменить в каком направлении давать больше виз, а в какой меньше. Лотерею отменят, допустим. Появится новая рабочая виза для высококвалифицированных и низкоквалифицированных рабочих. Тогда получается Джоб Оферы получить должно легче и проще, чем сейчас. Мне так кажется только. А иначе незачем удалять что-то, что в принципе не обязательно удалять.
Они собираются отменять категорию f4 только для новых аппликантов или те кто уже в очереди ждет priority date их тоже отменят?
